Public Law Remedies - Prerogative Writs – Certiorari, Mandamus and Prohibition

I have obtained orders against individuals and entities exercising public law duties who have attempted to abuse their powers and privileges.

I have obtained prerogative orders against the Medical Council of Guyana preventing them from harassing the most qualified and distinguished Gynaecologist and Obstetrician in Guyana Dr. Narine Datt Sooknandan by attempting to remove his name from the Medical Register.

I obtained orders against Guyana Power & Light Inc. (GPL) compelling them to install a meter to a customer.

I have also resolved many matters involving GPL electricity charges without resort to the Courts.

I obtained orders against the Registrar of Deeds preventing her from revoking a Certificate of Business Names Registration without giving the holder a fair hearing.

I obtained orders in favour of a businessman Reaaz Khan against the Controller of Customs ordering him to release 4 containers of goods. Upon his refusal to comply with the Court Order, it was followed up by contempt proceedings.

In association with Mr. Rex H. Mc Kay, S.C., Orders were obtained preventing a former Commissioner of Police (ag) from unlawfully removing a Commander from his office as Assistant Commissioner of Police in the Guyana Police Force.

I obtained orders on behalf of local company preventing the Minister of Finance from increasing the customs tariff on imported frozen chicken leg quarters from 40 per cent to 125 per cent, an increase of 212 per cent on the ground it was unlawful, unenforceable and in breach of the General Agreement on Tariff and Trade (GATT) to which the Government of Guyana is a signatory and the WTO/Uruguay Round of Negotiations.

In association with Mr. Rex H. Mc Kay, S.C., Court orders have been obtained against the Georgetown City Council preventing them from demolishing a building without giving the owner a fair hearing and complying with procedures.

Injunctive Orders

I obtained injunction orders directing the Guyana Revenue Authority (GRA) to release a Toyota Hilux Surf motor vehicle PJJ 473 unlawfully seized by the Customs department and the Police.

Discharge of Ex Parte Injunction

I successfully got discharged an ex parte injunction obtained by a Company incorporated in the United States AMR Gold Resources Inc. and its subsidiary AMR Gold Resources (Guyana) Inc. against a Guyanese which prevented him from terminating an Exploration and Mining Agreement and their operations on the mining claims.


Exploration and Mining

I was involved in the drafting of an Agreement between a Guyanese Wayne Vieira and a Canadian Company StrataGold Corporation and its local subsidiary for the sole and exclusive right to occupy, prospect, explore and mine gold in 4 Mining blocks at Tassawini, North West District of Guyana. StrataGold is a large scale investor in Guyana and its shares are traded on the Toronto Stock Exchange.

Property matters

At the High Court, Full Court and the Court of Appeal, I successfully represented several former Guyanese living overseas who owned property in Guyana and left a caretaker in charge and then the occupants attempted to claim ownership of property.

I represented Isha Ragbir a Guyanese living in New York and was able to regain possession of her property in Guyana which was unlawfully taken possession of by another person who took advantage of fact that the owner was living abroad.
 
I successfully represented Birgit & Eldad Dookie who were occupiers of land from birth at  Plantation Hoop-en-Vries, Northern Hogg Island, Essequibo River and got discharged an exparte injunction obtained by one Khairool Sarabjeet against Birgit and others preventing them from going onto the land.  

Property - Correction of Transport

I have successfully obtained a court order in favour of a businessman who purchased a property in Georgetown and then discovered his Transport described a lesser portion then what he had purchased.

Real Estate - Sale of Property

I have a large conveyancing practice. I have represented local and overseas based Guyanese for the sale and purchase of real estate in Guyana.

Tort - Personal Injuries

Although cases involving damages for Personal Injuries usually take several years to be heard, I have successfully obtained judgments in favour of persons who suffered personal injuries. Personal injuries cases comprise mainly motor vehicle accidents. Injuries include facial scarring and disfigurement, injury to eye, amputated left leg, lumbar scoliosis convex to the right, broken leg, loss of kidney and spleen and other personal injuries to limb.  

                    
Division of Property

I have represented a 76 year old housewife, who had no means and was put out of possession of her matrimonial home. I successfully obtained an order from the Honourable Justice W. Patterson of the High Court of the Supreme Court giving her a half share of the matrimonial property in which she now resides. This was followed up by obtaining the actual title document for her.

I represented a wife and mother of two infant children and obtained a consent order granting her the entire matrimonial property which was in the sole name of the husband permitting the mother and her children to live in peace. I also obtained her divorce absolute order on the ground of the husband’s malicious desertion.

I represented a wife and mother of three infant children and obtained her divorce, custody of children with reasonable access to husband and an order that the husband transfer the entire matrimonial property to wife and children. Husband who had deserted wife, was permitted to keep mini bus from which he derived his income and another motor vehicle.

I was involved in division of property proceedings for a businessman brought by his ex wife. After much bickering and hostility for many years, the parties arrived at an amicable settlement. I drafted the settlement agreement which included the businessman consenting, inter alia, to give the ex wife the property in which she lived with her adult son and daughter in law and a substantial monetary lump sum and a monthly sum of money. In this matter, all the outstanding issues were amicably resolved by the parties.

I represented a wife and working mother of two infant children. After obtaining her divorce on the ground of her husband’s malicious desertion, in proceedings brought for division of property, my client was able to receive by consent a land obtained from the Government which was obtained during the course of the marriage and put in the name of the husband alone.  

 

Custody of Children in Guyana

Acted on behalf of Guyanese and foreign mothers and fathers and obtained custody and or reasonable access or visitation orders in relation to children.

In custody proceedings brought on behalf of a housewife, I obtained a consent custody order in her favour for the two infant children with reasonable access to the father and an order that the father of children pay to the mother a fixed sum of money for the maintenance of the children, plus their school fees and the cost of school supplies. The husband also had to provide transportation for the children to go to school.

I have obtained orders against fathers (Guyanese and foreigner) preventing them from taking children out of Guyana without the permission and written consent of mother.

 

Arbitration

Ms. Jamela A. Ali was also involved in Arbitration proceedings with an International Company Sociedade De Construcoes Soares Da Costa S.A. from Portugal and the Attorney General on behalf of the Government of Guyana.
