(Legislative Drafting) (UWI) As former Counsel at the Attorney General's Chambers, having specialised in Public law, a former member of the Adoption Board and Counsel in Private Practice at the Bar in Guyana, Ms. Jamela A. Ali has been involved in significant developments in the field of advocacy and legal practice in the Magistrate Courts, Land Court, Commercial Court, High Court, Full Court and the Court of Appeal of the Supreme Court of Judicature of Guyana. Legal services and solutions are offered in the following areas:
Commercial Court matters Cases include claims for money, the purchase and sale of commodities and contracts relating to the sale and purchase of land. Property matters This practice includes obtaining possession of property, property disputes, land grabbing and sale of real estate.
Conveyancing Conveyancing matters include the preparation of Agreements for the sale and purchase of real estate, advice on agreements of sale, the vesting of Transports, Leases and Certificates of Title from the estates of deceased persons and transferring property by gift from one person to another. The processing of conveyancing matters at the Deeds Registry and the Land Court is handled by efficient and experienced staff. Prescriptive Title & Registration of Title In Guyana, many persons have been in occupation of land without any title documents. Applications can be made to the Land Court of Guyana under the Title to Land (Prescription and Limitation) Act for Transports or Leases to property for clients who have been in adverse possession of land in excess of 12 or 30 years and for various reasons have not been able to obtain Title documents in their names. Notices of Opposition to prescriptive title being granted to persons who attempt to unlawfully obtain title can also be undertaken. Applications for Registration of Certificate of Title by adverse possession under the Land Registry Act can be made. Public law remedies Litigation can be undertaken in areas involving constitutional and administrative law to prevent a misuse or abuse of power and arbitrary and unlawful conduct by individuals holding public office or carrying out duties of a public nature such as Guyana Power & Light Inc. (GPL), City Council, Guyana Revenue Authority (GRA) and NICIL by obtaining prerogative writs or orders of Certiorari, Mandamus and Prohibition. Injunctions Representation is provided to obtain urgent injunctive relief against individuals or bodies to prevent unlawful, arbitrary, unreasonable and abusive conduct. This practice also includes successfully discharging ex parte injunctions wrongfully obtained. Mining law Services include providing legal advice and representation as Counsel for individuals, Guyana and International companies involved in gold, diamond, uranium and manganese exploration, prospecting and mining. Also the drafting of several types of Agreements for individuals, Guyana and foreign Companies relating to the mining industry. Tort The practice includes cases on the Law of Libel and Slander, Negligence, Trespass, Nuisance, Damages for Personal Injuries and Fatal Accidents. Contract This includes advice and representation in matters for damages for breach of contract and the drafting and interpretation of various contracts. Family and Matrimonial The services offered include advice and representation on Divorces, Division of Matrimonial Property, Alimony and any other matter relating to breakdown of a legal marriage or union between a wife, husband or spouse. Children -Adoption & Custody This includes advice on the adoption laws of Guyana, including the adoption of children by Guyanese living in Guyana as well as Guyanese and former Guyanese living abroad and the processing of applications for the adoption of children. Also custody of children matters are handled and applications for reasonable access of children by one parent. Company and Corporate Law Preparation of Agreements The practice includes offering advice, drafting and interpreting Agreements for individuals, Guyana and foreign Companies on various subject matters. Contracts are prepared to ensure that clients derive maximum advantage from business transactions. Probate and Administration This includes obtaining Grants of Representation from the High Court for Probates, Letters of Administration and Resealing of Probates and Letters of Administration of the estates of deceased persons. Also estate planning advice and the drafting of Wills. Trade Marks Trade Marks are registered in respect of classes of goods and registration gives exclusive right to the use of the trade mark in respect of the goods registered. Registration under the Act protects the registered proprietor of the trade mark from any action for infringement and entitles the person to bring an action for infringement. Legislative Drafting Advice and the drafting of legislation can be undertaken. Ms. Jamela A. Ali has a Master of Laws degree in Legislative Drafting and is the author of several articles and presentations on legislative drafting and law reform.
Ms. Jamela A. Ali is also a trained Mediator whose name has been placed on the first Roster of Mediators for the Guyana Court-Connected Mediation Project by the Supreme Court of Judicature of Guyana. Since her appointment, she has conducted several mediations. She is also a Mediation Trainer and Faculty Member. While recognising the importance of litigation, mediation has a significant place in resolving disputes in a private informal environment. The value of Mediation is that it empowers the parties to create their own solutions and can be used to resolve legal matters quickly, efficiently and cost-effectively as possible. Arbitration These services can be undertaken. Miscellaneous This includes writing letters on various matters, including Letters of Demand and replies, Affidavits, various types of Powers of Attorney, Promissory Notes, Deeds of Gift, Tenancy and all other types of Agreements, Notices to Quit, Deed Polls, Caveats and Bills of Sale. Whereever necessary, we dedicate considerable time and effort to pro bono work especially for women and vulnerable children towards the promotion of the administration of justice. Contributions are made regularly to the Education and Orphan Fund of the Central Islamic Organisation of Guyana (CIOG) to ensure that under privileged children have access to education.
